Terms and conditions of sale

This English translation is provided for information only. Only the French version of these terms and conditions is legally binding; in the event of any difference, the French version prevails.

Article 1 – Identification of the seller – Scope

These general terms and conditions of sale ("T&Cs") apply to the services sold on the website monkeyprorider.com by:

FULLBIZ, a French single-shareholder simplified joint-stock company (SASU) with share capital of €1,000, trading as #MONKEYPRORIDER, registered with the Montpellier Trade and Companies Register under no. 944 583 046, with its registered office at 10 rue Église Vieille, 34770 Gigean, France. Telephone: +33 6 87 25 98 68 – Email: monkeyprorider@gmail.com. Hereinafter "#MONKEYPRORIDER".

The services concerned are: advanced road riding courses, track coaching and track riding sessions, motorcycle pillion rides on a track, the options offered to holders of gift boxes, and the hire of motorcycles and equipment linked to these services (hereinafter the "Service(s)").

The term "CUSTOMER" means the natural person who buys a Service for their personal needs, or for a beneficiary they designate (the "participant"). The CUSTOMER declares that they are of legal age and able to enter into a contract. A minor may only take part with the prior written authorisation of their legal representative.

The CUSTOMER acknowledges having read and accepted these T&Cs by ticking the box provided for this purpose before confirming their order. The applicable T&Cs are those in force on the date of the order. They can be accessed at any time on the website and can be saved or printed.

Article 2 – Motorcycle tours: sold by the association, outside these T&Cs

The motorcycle tours and road trips presented on monkeyprorider.com are organised and sold exclusively by MPR MONKEYPRORIDER L'ASSOCIATION, a non-profit association under the French law of 1901, Espace entreprise, 48 rue Claude Balbastre, 34070 Montpellier, France – SIRET 925 173 031 00012 – RNA W343029946, registered with Atout France on the register of travel and holiday operators under no. IM034250005, UNAT financial guarantee, Hiscox professional liability insurance.

The travel contract is concluded directly between the traveller and the association, on the website association.monkeyprorider.com, under the association's general and specific terms of sale (in French), which comply with the French Tourism Code. FULLBIZ is neither the organiser nor the seller of these tours and receives no payment for them. These T&Cs do not apply to tours.

Likewise, the association's rides and events are sold by the association, under its own terms.

Article 3 – Orders

The CUSTOMER selects the Service, the date and the desired options, provides accurate and complete information, reads the T&Cs, then confirms the order and pays. Before final confirmation, they can check the details of their order and its total price, and correct any errors.

The order is confirmed by a summary email setting out its essential elements. #MONKEYPRORIDER reserves the right to refuse an abnormal order, an order placed in bad faith, or an order in the event of a payment incident.

Conditions of participation – track. Each participant in track coaching or a track riding session must hold a valid motorcycle driving licence, or the CASM (Certificat d'Aptitude au Sport Moto) issued by the French Motorcycling Federation (FFM), or a valid FFM licence, or the FFM Pass Circuit. Participants who are minors must hold the CASM or the FFM Pass Circuit. These conditions do not apply to the passenger on a pillion ride.

Conditions of participation – road. The advanced road riding course takes place on the participant's own motorcycle. The participant must hold a valid licence for their motorcycle, and the motorcycle must be insured, up to date with its roadworthiness test where applicable, and legal to ride on public roads.

Article 4 – Dates of Services

The date chosen when ordering is confirmed by email on receipt of payment. The exact times and meeting place are sent by email no later than 3 weeks before the Service.

If a date becomes unavailable due to #MONKEYPRORIDER, the CUSTOMER is informed without delay and may choose between another proposed date and a full refund of the sums paid, including options.

Article 5 – Prices and payment

Prices are shown in euros, all taxes included. The applicable price is the one displayed on the website at the time of the order. It only includes the elements described on the Service page.

The price is payable in full when ordering, by card, via a secure payment solution. #MONKEYPRORIDER never has access to card details. An order not paid within 7 days may be cancelled.

Article 6 – No right of withdrawal – Gift vouchers

In accordance with Article L221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to leisure services provided on a specific date or during a specific period. Services booked for a date therefore cannot be withdrawn from; they are subject to the cancellation conditions of Article 7.

Gift vouchers sold by #MONKEYPRORIDER without a service date: the buyer has a withdrawal period of 14 days from purchase, by sending a request by email to monkeyprorider@gmail.com; they are then refunded within 14 days. The gift voucher is valid for 12 months from purchase; the date is booked by the beneficiary, subject to availability.

Gift boxes from other brands. The validity, exchange and refund conditions of the gift box are those of the issuing brand. Options paid for on monkeyprorider.com by the holder of a gift box are subject to these T&Cs.

Article 7 – Cancellation and postponement

7.1 Cancellation by the CUSTOMER

Any cancellation must be sent by email to monkeyprorider@gmail.com or by post. The date of receipt is authoritative; an acknowledgement of receipt is sent. Without the cancellation option, the following amounts are retained:

  • more than 60 days before the Service: 25% of the price (75% refunded);
  • between 59 and 45 days: 50% of the price (50% refunded);
  • between 44 and 16 days: 75% of the price (25% refunded);
  • 15 days or less: 100% of the price (no refund).

The percentages apply to the price of the Service, excluding the price of the cancellation option and any administration fees, which remain due. At any time before the Service, the CUSTOMER may transfer their place to a person who meets the conditions of participation, by notifying #MONKEYPRORIDER by email; no fees are then retained.

If the participant does not show up on the day of the Service, without prior cancellation, no refund is given.

7.2 Cancellation / postponement option

When ordering, the CUSTOMER may take out a CANCELLATION / POSTPONEMENT OPTION costing 12% of the price of the Service. It then replaces the scale in Article 7.1.

It allows a refund in the event of:

  • medical incapacity of the participant, supported by a certificate from a health professional;
  • death of the spouse or of a first- or second-degree relative, with supporting evidence;
  • breakdown, theft or accident of the vehicle intended for the course, supported by a professional's quote, an expert's report or a police report.

The supporting document is sent by email or by post. The refund is then:

  • more than 60 days before the Service: 100% of the price;
  • between 59 and 45 days: 90% of the price;
  • between 44 and 16 days: 80% of the price;
  • 15 days or less: 50% of the price.

Without a reason or supporting document, a CUSTOMER who has taken out the option may obtain a refund of 40% of the price, on request made no later than the day of the Service.

Instead of a refund, postponement to another date may be agreed by mutual consent; this counts as use of the option, and the new appointment is no longer covered by it.

The percentages apply to the price of the Service, excluding the price of the option and any administration fees.

7.3 Cancellation or postponement by #MONKEYPRORIDER

#MONKEYPRORIDER may cancel or postpone a Service when safety conditions are not met (weather, condition of the track or road, decision of the circuit or the authorities), if the site or the instructor is unavailable, or if the minimum number of participants shown on the Service page is not reached. The CUSTOMER is informed as soon as possible.

In all these cases, the CUSTOMER chooses between postponement to another proposed date and a full refund of the sums paid, including options, within 14 days. Where the cancellation results from force majeure within the meaning of Article 1218 of the French Civil Code, no other compensation is due.

When a Service is interrupted during the day for safety reasons (rain on the track in particular), #MONKEYPRORIDER offers to postpone the part not carried out or to refund a proportional share of it.

7.4 Motorcycle hire

Hiring a motorcycle from the #MONKEYPRORIDER fleet is an option linked to the Service. It follows the cancellation conditions of the Service (Articles 7.1 to 7.3).

Article 8 – Content of the Services

8.1 Advanced road riding courses

The courses take place on the participant's motorcycle and are led by an FFM-qualified coach. The technical part takes place on the private track of the Col de la Cardonille, a former road closed to traffic and reserved for training, followed by practice on open roads.

The one-day course includes training on the closed track and a practice ride. Participants bring their own packed lunch.

The two-day course also includes dinner, accommodation in a shared room (guest house, riders' inn or hotel), breakfast and lunch on the second day, as well as a full day of training on the road.

8.2 Track coaching and track riding sessions

The programme, the circuit, the riding time and the number of participants are shown on the Service page. The participant must comply with the circuit's internal rules, in particular noise limits.

8.3 Pillion rides on a track

The pillion ride is carried out as a passenger behind a #MONKEYPRORIDER rider. The passenger's full gear is provided. Whether the ride goes ahead depends on weather and safety conditions, as assessed by the person in charge on site. In the event of postponement, Article 7.3 applies.

Article 9 – Hire of motorcycles and equipment – Deposit

The provision of a motorcycle from the #MONKEYPRORIDER fleet is subject to a deposit, paid before the Service by cheque or card pre-authorisation, of: Honda CB 500: €3,000; Kawasaki ZX-6R: €3,500; Kawasaki Ninja 400: €4,500.

A joint inspection is carried out at departure and return. In the event of damage, #MONKEYPRORIDER draws up a repair quote, sent to the CUSTOMER as soon as possible. Scratched parts are repainted where possible; broken or abraded parts are replaced. The sum due from the CUSTOMER corresponds to the amount of this quote, up to the amount of the deposit, and is paid within 30 days. Failing payment, the deposit is cashed up to the amount of the quote. The amount of the deposit is the maximum that may be claimed from the CUSTOMER for damage caused to the motorcycle.

For equipment, the deposit is: leathers with back protector: €800; helmet: €150; boots: €150; gloves: €110. In the event of damage, only the sum corresponding to the repair or, if the equipment can no longer be used safely (in particular a helmet that has suffered an impact), to its replacement is retained, on supporting evidence, up to the amount of the deposit.

The deposit is returned or destroyed after the equipment is returned in good condition.

Article 10 – Participant's obligations

The participant follows the safety rules and instructions given by the staff, as well as the circuit rules or the Highway Code, as the case may be.

Mandatory equipment on track: leather gear (one-piece suit, or trousers and jacket joined by a zip), leather boots or ankle boots and leather gloves, an approved full-face or modular helmet, back protector. Equipment can be hired as an option for coaching; it is provided for pillion rides.

Mandatory equipment on the road: approved helmet and CE-certified gloves (legal requirements); a jacket, trousers and high-top footwear suitable for motorcycling are strongly recommended.

The participant's motorcycle must be well maintained, in particular the brakes and tyres. A participant who turns up without the mandatory equipment or with a motorcycle that does not meet the required safety conditions cannot take part, for their own safety and that of others; the Service then remains payable, unless the problem can be remedied on site.

#MONKEYPRORIDER may exclude a participant whose behaviour endangers their own safety or that of others; the Service remains payable.

During a pillion ride, the passenger follows the instructions of the safety briefing to the letter. A sighting lap is carried out and the rider may stop to repeat the instructions. A passenger who does not follow these instructions is liable for the damage they cause, under ordinary law.

Article 11 – Liability – Insurance

Riding a motorcycle, on the road as on the track, involves inherent risks (falls in particular). #MONKEYPRORIDER implements the means necessary for the safety of the Services and is liable for damage resulting from a breach of its obligations, under ordinary law. It cannot be held liable for damage resulting from the participant's failure to follow instructions, from the act of a third party or from force majeure.

In accordance with Article L321-1 of the French Sports Code, #MONKEYPRORIDER has taken out professional liability insurance covering its activities.

On track, each participating rider must be covered by liability insurance suitable for track riding; #MONKEYPRORIDER states on the Service page whether this insurance is included or offered by the track-day organiser.

In accordance with Article L321-4 of the French Sports Code, #MONKEYPRORIDER informs the CUSTOMER of the benefit of taking out personal insurance covering the bodily injury to which motorcycling may expose them ("personal accident" or "rider" cover), with their insurer, the FFM or the track-day organiser.

Article 12 – Personal data

The data collected when ordering is necessary for its performance and is processed by FULLBIZ, the data controller. Details of the processing, retention periods and your rights (access, rectification, erasure, objection, in particular to marketing) are given in our privacy policy. You can exercise your rights at monkeyprorider@gmail.com and lodge a complaint with the CNIL.

Article 13 – Photos and videos

Photos and videos may be taken during the Services. With the participant's consent, obtained when ordering or on site, they may be used for #MONKEYPRORIDER's communication (website, social media, brochures), without financial compensation. The participant may refuse or withdraw their consent at any time by email to monkeyprorider@gmail.com; the images concerned will no longer be used for new publications.

Article 14 – Complaints – Mediation – Applicable law

Any complaint should be sent to monkeyprorider@gmail.com or by post to FULLBIZ's registered office.

In accordance with Articles L612-1 et seq. of the French Consumer Code, in the event of a dispute not resolved by a prior written complaint, the CUSTOMER may refer the matter free of charge to the consumer mediator to which FULLBIZ belongs, whose contact details are available on request at monkeyprorider@gmail.com.

These T&Cs are governed by French law. Failing an amicable solution, the dispute will be brought before the competent court in accordance with ordinary rules.

If any clause of these T&Cs is declared void, the other clauses will remain applicable.

T&Cs in force on 8 October 2026 (French version).
